In the Year One Thousand Nine Hundred and Seventy

AN ACT MAKING DOMESTIC EMPLOYEES SUBJECT TO THE LABOR LAWS. 

Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows: 

SECTION 1. Section 1 of chapter 149 of the General Laws is hereby amended by deleting from the paragraph defining “Employee” the words “engaged in domestic service in the home of the employer, or” and inserting in place thereof the following words: - under the age of 18 engaged in domestic service in the home of the employer, or persons engaged. 

SECTION 2. Section 1 of said chapter 149 is hereby further amended by inserting after the words “private domestic service” within the paragraph defining “Employment” the following words: - by persons under the age of 18. 

SECTION 3. Section 3 of said chapter 149 is hereby amended by inserting after the words “places of employment” the following words: - , other than places of employment of persons engaged in domestic service in the home of the employer,. 

SECTION 4. Section 6 of said chapter 149 is hereby amended by inserting after the words “places of employment,” in the second line of the first paragraph thereof the following words: - , other than places of employment of persons engaged in domestic service in the home of the employer,. 

SECTION 5. Section 10 of said chapter 149 is hereby amended by inserting after the words “places of employment” the following words: - , other than places of employment of persons engaged in domestic service in the home of the employer,. 

SECTION 6. Section 17 of said chapter 149, as amended by chapter 585 of the acts of 1961, is hereby amended by inserting after the words “places of employment” the following words; - , other than places of employment of persons engaged in domestic service in the home of the employer,. 

SECTION 7. Section 24C of said chapter 149 is hereby amended by inserting after the words “business or employment” the following words: - , other than places of employment of persons engaged in domestic service in the home of the employer,. 

SECTION 8. Section 241 of said chapter 149 is hereby amended to read: - Sections twenty-four A to twenty-four H. 

inclusive, shall not apply to persons employed in service as farm laborers. 

SECTION 9. Section 56 of said chapter 149, as appearing in chapter 44 of the acts of 1961, is hereby amended by inserting after the word “exchange” in the tenth line of the first sentence thereof the following words: - , or in domestic service in the home of the employer,. 

SECTION 10. Section 56 of said chapter 149 is hereby further amended by inserting after the words “hereinafter designated,” in the sentence immediately succeeding the sentence amended by section 2 of chapter 357 of the acts of 1967, the following words; - , and except employers of persons in domestic service in the employer’s home,. 

SECTION 11. Section 105C of said chapter 149 is hereby amended by inserting after the words “places of employment” the following words: - , other than places of employment of persons engaged in domestic service in the home of the employer,. 

SECTION 12. Section 148 of said chapter 149, as appearing in chapter 415 of the acts of 1960, is hereby amended by deleting from lines 34 and 38 thereof the words “or in domestic service.”

SECTION 13. Section 2 of chapter 151 of the General Laws is hereby amended by deleting from the paragraph defining “Occupation” the words “domestic service in the home of the employer,”. 

SECTION 14. Subsection (2) of section 3 of said chapter 151 is hereby amended by inserting after the word “occupation” the following words: - , other than domestic service in the home of the employer,. 

SECTION 15. Section 16 of said chapter 151 is hereby amended by inserting after the words “Every employer”, the following words: - , except employers of persons engaged in domestic service in the employer’s home,. 

SECTION 16. Section 17 of said chapter 151 is hereby amended by inserting after the words “place of employment” the following words: other than places of employment of persons engaged in domestic service in the home of the employer,. 

SECTION 17. Subsection (3) of section 19 of said chapter 151 is hereby amended by inserting after the words “place of employment” the following words: - , other than places of employment of persons engaged in domestic service in the home of the employer,.
